CONFIDENTIALITY AGREEMENT

This confidentiality agreement (“Agreement”) is entered into on the date of registration by and between Pharmacy SOS (“Company”) and all Locum Pharmacists (“Locum Pharmacist”) who register with Pharmacy SOS.

WHEREAS, Locum Pharmacist will have access to confidential information of the Company’s clients, including patient information.

NOW, THEREFORE, in consideration of the premises and mutual promises contained herein, the parties agree as follows:

  1. Confidentiality Obligations. Locum Pharmacist agrees to abide by all Australian federal and state privacy and confidentiality laws and regulations, as well as AHPRA and Pharmacy Board Codes of Conduct, and to maintain the confidentiality of patient information at all times during and after the course of their employment with the Company.
  2. Use of Patient Information. Locum Pharmacist shall only use patient information for the purpose of providing healthcare to the patient. No patient information shall be taken out of the premises whatsoever.
  3. Consequences of Breach. Locum Pharmacist understands that a breach of patient confidentiality can result in significant harm to the patient and damage to the Company’s reputation. Any breach of patient confidentiality will result in disciplinary action, up to and including termination of employment. In addition, the Locum Pharmacist may be held legally liable for any damages that may result from the breach of patient confidentiality.
  4. Non-Use of Patient Information. Locum Pharmacist shall not look up patient data for any other reason than patient care in the process of their health care.
  5. Survival. The obligations of confidentiality and non-use of patient information shall survive the termination of this Agreement and the Locum Pharmacist’s engagement with the Company.
  6. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the state of employment.
  7. Entire Agreement. This Agreement contains the entire understanding of the parties and supersedes all prior and contemporaneous agreements and understandings, whether oral or written, relating to the subject matter of this Agreement.

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date of registering with Pharmacy SOS.
